Anyone who applies for a pharmacology license must first undergo a background check by the United States Department of Justice. Like many professional license holders, applicants must submit their fingerprints to be run through the nationwide database to check for any type of criminal history. Upon discovery of such activity, the Board of Pharmacy can deny licensure, and can revoke, suspend, or deny renewal of a current license holder.
If you applied for a pharmacology license and you were denied, please be advised that you have 60 DAYS to act – you must submit a written appeal to the Board of Pharmacy, requesting a formal administrative hearing. Under §4301, action can be taken against a licensee who is guilty of “unprofessional conduct,” which can include a broad spectrum of instances. Immorality, incompetence and gross negligence are the first three examples of offensive conduct, but the code goes on to condemn acts of “moral turpitude,” and convictions for offenses that are “substantially related” to the qualifications, functions and duties of the license holder. Of course, violations of laws related to distribution, sale, and procurement of controlled substances are also actionable by the Board and will likely lead to disciplinary action being taken against the licensee.
